St. Paul MAN CHARGED With SECOND-DEGREE MURDER in Fatal Shooting of GIRLFRIEND’S ESTRANGED SPOUSE

ST. PAUL, Minn. — A St. Paul man is charged with killing his girlfriend’s estranged spouse nearly a year after the husband reportedly shot the boyfriend in both legs.

The 32-year-old male is charged with second-degree murder, according to court filings filed in Ramsey County on Wednesday.

According to the criminal complaint, the boyfriend was shot outside while working on a car in the 800 block of York Avenue on August 29, 2023. The boyfriend said he had no idea who shot him, but the girlfriend told police her divorced husband shot him “out of jealousy.”

The spouse was not charged with the shooting “because the case could not be proved against him beyond a reasonable doubt,” according to the complaint.

On Monday, almost ten months later, officers arrived at the same residence and discovered the husband shot in the chest. He died at the spot. The Ramsey County medical examiner identified the victim as Jonathon Diaz, 35, of St. Paul.

Witnesses identified the boyfriend as the gunman and claimed he escaped on a bike, according to the lawsuit.

Officers discovered spent casings and a 9mm handgun in the garage.

The girlfriend and her kid were in the kitchen of the residence when the shooting occurred and fled when they heard gunshots, according to the complaint.

The girlfriend’s daughter and son both stated that they spotted the boyfriend at the scene of the shooting.

“I told you I was going to kill him,” the boyfriend allegedly stated.

The girlfriend then told authorities that she had been separated from Diaz for four years and had been with her boyfriend for three years. She claimed the two men didn’t get along, and that on the day of the murder, the boyfriend was unhappy because Diaz had stopped by the house to see his child as per CBSNEWS.

The boyfriend was detained on Tuesday and remains in police custody.

The shooting was St. Paul’s 13th homicide of the year.
