U.S. Immigration and Customs Enforcement (ICE) apprehended a Haitian man who was in the country illegally for allegedly raping a pregnant lady at a Massachusetts migrant hostel.
Enforcement and Removal Operations (ERO) Boston apprehended 34-year-old Marc Kervens Beauvais on August 13 in Peabody, north of Boston, nearly two weeks after he was arrested on charges of aggravated rape, two counts of assault and battery with a dangerous weapon on a pregnant victim, and attempting to commit a crime.
According to various law enforcement officials, the rape took place inside a migrant hotel. Beauvais was arrested by the Peabody Police Department for the offenses on July 31 and arraigned in Peabody District Court on August 1.
While in detention, ERO Boston filed an immigration detainer against Beauvais.
A judge released Beauvais on his recognizance after a court hearing on Tuesday, but ICE authorities arrested him right away.
“Marc Kervens Beauvais has been charged with committing unspeakable acts against a pregnant woman in Massachusetts,” ERO Boston Field Office Director Todd M. Lyons stated. “We just cannot allow somebody who poses such a threat to prey on the citizens of our towns.
“ERO Boston will continue our mission of prioritizing public safety by aggressively apprehending and removing egregious noncitizen offenders from New England.” According to ICE, Beauvais was apprehended by Border Patrol near Del Rio, Texas, on June 26, 2021, after illegally entering the United States. He was subsequently let into the United States and given a notice to report for processing.
The arrest occurred the same week that ICE discovered and arrested another Haitian immigrant, 26-year-old Cory B. Alvarez, who had been freed on $500 bond in June despite facing allegations of raping a child at a different Massachusetts migrant motel in March.
ICE had issued a detainer for Alvarez, but the local sheriff’s office ignored it and released him on nominal bond. A detainer is a request in which authorities notify ICE about an individual they feel is eligible for deportation so that the individual can be taken into federal custody and deported.
Alvarez was apprehended in a “sanctuary city,” and the detainer was ignored.
According to law enforcement officials, ICE officers discovered Alvarez on Tuesday in Brockton, Massachusetts.
Alvarez arrived in June 2023 as part of the Cuban, Haitian, Nicaraguan, and Venezuelan (CHNV) parole process. The program was first announced for Venezuelans in October 2022, allowing a limited number to fly directly into the United States provided they had not entered illegally, had a sponsor in the country, and satisfied specific requirements.
Alvarez’s charges stem from a March incident in which he was accused of raping a 15-year-old girl while sleeping at a migrant hostel in Massachusetts. A lawyer for him claims he is innocent of the charges.
