A group of more than 40 lawmakers have joined forces to support the state of Texas in its ongoing legal dispute with the Biden administration. Earlier this year, the Justice Department filed a lawsuit against Texas over a law that grants Texas police the authority to apprehend undocumented immigrants.
Arrington’s remarks coincide with Texas’ upcoming legal battle to uphold a state law enacted by Republican Governor Greg Abbott in December. This law grants Texas law enforcement officers the power to apprehend and prosecute undocumented immigrants, a matter that the Justice Department contends falls within federal jurisdiction.
The lawsuit, filed in an Austin federal court, asserts that the United States is taking action to uphold its exclusive authority under federal law in regulating the entry and removal of noncitizens. “Texas lacks the capability to manage its own immigration system.”
The actions taken by SB 4 have been seen as an infringement on the federal government’s sole jurisdiction over the regulation of noncitizen entry and removal. These actions have caused complications in the United States’ immigration operations and proceedings, as well as interference with foreign relations.
Arrington asserts that the law is not only constitutional, but was deemed necessary due to the Biden administration’s inability to address the crisis at the U.S. border with Mexico.
“It is evident to any impartial individual residing in this nation that President Biden has deliberately ignored the laws of the land, neglected his constitutional responsibility to ensure national security, and unilaterally handed over control of our border to criminal drug cartels,” Arrington stated.
“President Biden’s approach to law enforcement and border security has been lacking, as evidenced by his failure to enforce our laws and secure our border. Furthermore, he has actively impeded Texas’ attempts to fulfill the responsibilities that should be carried out by the federal government, such as the DOJ lawsuit over SB4.”
Texas Alleges Federal Failure in Border Protection, Takes Legal Action Against Influx of Migrants
The brief, filed in the US district court for the western district of Texas—Austin Division on Tuesday evening and reviewed by Fox News Digital, alleges that the federal government has failed in its responsibility to protect states from invasion and ensure the faithful execution of the nation’s immigration laws.
The brief also alleges that the Biden administration is actively enabling the influx of migrants into the US, prompting Texas to take action in order to protect its borders and combat criminal drug cartels and the flow of unauthorized immigrants from various countries.
