Man Sentenced for Wife’s Death in Violent Confrontation at Her Lover’s Residence

A Michigan husband was jailed for fatally shooting his wife, who died during a gunfight at her lover’s home, where the husband had gone to instruct him not to contact her.

Matthew Louis Mollicone, 48, learned his destiny on Wednesday following the death of his wife, Kimberly Ann Mollicone, 49. Prosecutors revealed in a news release that he will serve 86 months to 15 years for voluntary manslaughter, 12 to 40 years for assault with intent to murder, and two years to run consecutively for three counts of felony firearm. Mollicone was found guilty in May.

“The court’s decision to give a lower sentence than we requested does not minimize the gravity of the offense committed. We believe the evidence given called for a higher penalty to reflect the severity of taking a human life. Nonetheless, we accept the court’s decision and remain committed to obtaining justice for the victim and their family,” Macomb County Prosecutor Peter J. Lucido stated in a news statement.

According to Law&Crime, the killing occurred on July 12, 2022, when Matthew Mollicone and his wife traveled to Daniele Giannone’s home at 9:30 p.m.

When the couple arrived at the house on the 62000 block of North Avenue in Ray Township, roughly 45 miles north of Detroit, Giannone was outside grilling on his barbecue. A dispute swiftly turned into a firefight. Both males fired handguns at one another. Giannone was hit on the leg. He went into his house and got a second firearm.

As Matthew Morricone and his wife ran to their vehicle and began to back out of the driveway, the two men fired additional gunfire, and Kimberly Morricone was wounded in the neck and died, according to officials.

Officials stated that the incident lasted less than two minutes. Several Giannone family members were “trapped inside the home out of fear” throughout the shootout. More than 30 bullet casings were found on three firearms.

According to the Macomb Daily, Giannone testified that he had no idea why Mollicone was present on the day he rushed him.

“I told him I didn’t know what he was there for,” Giannone stated. “I said, ‘Get out or I’ll blow your f—ing head off.”

The drama unfolded via 911 calls about the shootout.

“I need someone here right now!” “Somebody just keeps shooting at my house,” a woman screams, as multiple gunshots ring out in the background. “My brother was shot!” My sister-in-law is in the house with my children, bunkered down. My parents are here!”

When asked to identify the shooter, the woman who called 911 stated that she did not know.

“He just got out of the vehicle and started shooting!” a woman can be heard saying. “He just started shooting, and he’s still around! “Please send someone here!”

Matthew Mollicone also called 911 during the incident. In the audio tape, he tells the dispatcher that a man “came out of his house and shot my wife.”

“Send an ambulance immediately. My wife has been shot. “She is unresponsive,” he can be heard saying.

Kimberly Mollicone’s obituary mentioned her mother warmly.

“Kimberly played many roles in her family, business, and community,” the obituary stated. “Her most prized role was Mother. She was very involved in her children’s lives in many areas, including their faith, school, and several sports. Kimberly was a vital component of the family company. Kimberly recently began to practice and enjoy yoga. Kimberly was incredibly active and passionate about helping the recovery community. “Her heart was open to anyone in need.”

The Oakland Press reported in court on Kimberly Mollicone and Giannone’s years-long affair, which her husband believed had lately resumed. Mollicone’s defense attorneys argued that Giannone should be charged with murder because he fired the fatal shot, but prosecutors claimed Mollicone put his wife at risk, according to Lawandcrime.
